Prerequisite: Our trips are suitable for experienced cyclists with safe bike handling skills. Our itineraries often include narrow roads without shoulders or guardrails and sometimes rough surfaces. Although we do our best to avoid busy roads, this is not always possible and guests should be comfortable riding on roads with motorized traffic. Guests need to bring a gps device to follow our provided routes. Guests are required to complete all point to point stages by bicycle and where possible we can provide shorter, easier options. Apart from any group airport transfers described in the trip brochure, we do not offer any transportation.
Reservation and Payment: To guarantee a spot on a trip, a $795 deposit is required from each guest. Full payment is due 90 days before the scheduled departure date of the trip. We only accept checks for payment. Please make checks out to BikePlusTours LLC and send them to BikePlusTours LLC, 1221 Nassau Way, Fort Collins, CO. The trip price is based on double occupancy. The trip brochure lists included and excluded items.
Cancellation and Refund: The deposit is fully refundable in case of cancellation by you up to 90 days before the scheduled departure date of the trip subject to us selling your spot to another guest. If we are not able to sell your spot to another guest, we will issue a credit for the full amount of the deposit to be applied to the final payment of a future trip with us by you. No refunds or credits will be issued in case of cancellation by you within 90 days from departure. Full payment is due 90 days before the scheduled departure date of the trip. Except in the cases mentioned above, the deposit is forfeited if payment in full is not received by then.
Trip Cancellation: We reserve the right to cancel a trip prior to departure for any reason. Except in case of ‘Force Majeure’, if we cancel a trip 60 days or more prior to the scheduled departure date of the trip a full refund which constitutes full settlement will be made. Except in case of ‘Force Majeure’, if a trip is cancelled by us within 60 days before the scheduled departure date, we will retain the amount paid by the guest and the guest will be able to use this towards final payment of a future trip to be used within two years of the cancellation date. Force Majeure means any event which we could not, even with all due care, foresee or avoid. Such events may include, whether actual or threatened, war, riot, civil strife, terrorist activity, epidemics and diseases, government imposed travel bans or embargo, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control. Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of Force Majeure.
Travel Insurance: Our trip packages do not include travel insurance. We strongly recommend that you purchase comprehensive travel insurance, covering trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you.
Responsibility: BikePlusTours LLC will not be responsible for personal injury, death or property damage, economic loss or delay, or change of itinerary suffered by any person or trip participant arising out of the negligent or intentional acts or omissions of any direct or supplemental carrier, hotel, restaurant or other person rendering any services or accommodations for any trip; nor will we be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reason or any circumstance beyond our reasonable control. We reserves the right to substitute hotels, restaurants, routes or other services listed in the itinerary with comparable services if necessary.
Photographs: We may use any photos or videos that you send to us, or that are taken by our guides and/or other guests of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the trip, you must inform us or your trip leader in writing at the start of the trip.
Governing Law: These Terms and Conditions and any claim, controversy, dispute or cause of action (whether in contract or tort or otherwise) based upon, arising out of or relating to these Terms and Conditions and the trip hereby reserved shall be governed by, and construed in accordance with, the law of the state of Colorado.
Submission to Jurisdiction – By reserving space on a trip you irrevocably and unconditionally agree that any action, litigation or proceeding of any kind or description, whether in law or equity, whether in contract or in tort or otherwise, shall be brought in the courts of the state of Colorado sitting in Larimer County or the United States District Court of the District of Colorado sitting in the City of Denver and you irrevocably and unconditionally submit to the jurisdiction of such courts.
Waiver of Venue – By reserving space on a trip you irrevocably and unconditionally waive any objection you may now or hereafter have to venue of any action or proceeding arising out of or relating to these Terms and Conditions or the trip hereby reserved in the Courts of the State of Colorado sitting in Larimer County or the United States District Court of the District of Colorado sitting in the City of Denver.
Waiver of Right to Trial by Jury – By reserving space on a trip you irrevocably and unconditionally waive, to the fullest extent permitted by applicable law, any right you may have to a trial by jury in any legal proceeding directly or indirectly arising out of or relating to these Terms and Conditions or the trip hereby reserved.
